Understanding Copyright Infringement

Submitting a DMCA Notification

If you believe that any material available on our Website infringes your copyright, you may submit a written notification (“DMCA Notification”) with the following information:

Upon receiving your DMCA Notification, we will take whatever action, in our sole discretion, we deem appropriate, including the removal of the challenged material from the Website.

Counter-Notification

If you believe that the material removed or disabled due to a DMCA Notification does not infringe copyrights or that you have the authorization from the copyright owner, the owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a written counter-notification containing the following information:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  2. A statement that you have a good faith belief that the material was removed or disabled as a result of a mistake or a misidentification of the material.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court in your location or, if you are outside the United States, in any judicial district where the service provider may be found.
  4. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA Notification. If the original notifier does not file a court action seeking a court order against you within 10 business days, we may restore the removed or disabled material.

Misrepresentations

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. You may want to seek legal counsel before submitting a notification or a counter-notification.
